Hyperliquid Energy Perpetuals Seek CFTC Path Into US Markets

Hyperliquid energy perpetuals could enter regulated U.S. markets under an Aug. 26 proposal submitted to the CFTC. Hyperliquid Policy Center and trade[XYZ] argue that current derivatives law already offers a route. Their filing covers contracts tied to WTI crude, Brent crude and Henry Hub natural gas. The CFTC has opened a consultation, but it has not approved these products.

Hyperliquid Energy Perpetuals Target Weekend Hedging Gaps

Unlike dated futures, perpetual contracts never expire. Recurring funding payments help align each contract with its reference price. That structure removes the need for regular contract rolls.

trade[XYZ] has offered energy contracts since October 2025. Its broader markets have processed more than $500 billion across over 80 listings. The filing says those figures cover several asset classes, including energy.

The groups say Hyperliquid energy perpetuals could help firms respond when traditional venues close. During one February weekend, roughly two-thirds of crude price movement occurred onchain before dated futures reopened.

A study in the filing reviewed 19 weekend closures. In almost 75% of those periods, the onchain closing price better indicated Sunday reopening levels than Friday benchmarks.

A standard WTI future represents about $70,000 at recent prices. The median off-hours crude trade on trade[XYZ] was roughly $1,300.

CFTC Review Tests Onchain Clearing and Stablecoin Margin

The CFTC review examines manipulation, reference prices, margin, clearing, surveillance and customer safeguards. It also asks how 24/7 energy trading could affect physical markets.

The filing says onchain systems can run execution, margin checks, settlement and recordkeeping continuously. According to trade[XYZ], its order book handled 97.9% of liquidated notional volume.

The filers say public ledgers can assist real-time surveillance. However, any operator offering Hyperliquid energy perpetuals would still face market-integrity and customer-protection rules.

The groups also seek approval for eligible stablecoins and tokenized assets as cleared-derivatives margin. A current CFTC pilot permits Bitcoin, Ether and USDC under reporting and risk controls.

The filing also seeks clear rules for weekend collateral transfers and business-day deadlines. Any Hyperliquid energy perpetuals listing would require separate regulatory clearance. The extended comment deadline was Aug. 26.
